These Terms and Conditions govern your use of avenue89.com and purchases made from Avenue 89. By accessing our website or placing an order, you agree to these terms.
Eligibility
You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order through this website.
Products
Avenue 89 creates hand-poured home-fragrance products in small batches.
Because our products are handmade, minor variations may occur in wax color, surface texture, fragrance appearance, vessel placement, packaging, or finish. These natural variations are not considered defects and do not affect the intended quality of the product.
We make reasonable efforts to display product photographs and colors accurately. However, colors and appearance may vary depending on lighting, photography, and device-screen settings.
Candle Safety
Customers are responsible for reading and following all candle-care and safety instructions supplied with the product and listed on our website.
Never leave a burning candle unattended. Keep candles away from children, pets, drafts, flammable objects, and heat-sensitive surfaces. Do not burn a candle for more than four hours at a time, and discontinue use when approximately one-half inch of wax remains.
Avenue 89 is not responsible for damage or injury caused by misuse, failure to follow safety instructions, or use of a product for an unintended purpose.
Pricing
All prices are listed in U.S. dollars and may change without notice.
The price charged will be the price displayed at the time the order is submitted, unless an obvious pricing or technical error has occurred. Taxes and shipping charges, where applicable, are calculated at checkout.
Preorders
A preorder reserves a product scheduled to ship at a later date.
The estimated shipping date or processing window will be displayed on the website or product page before purchase. Dates are estimates based on available information and may be affected by production, supply, carrier, or other circumstances.
If Avenue 89 cannot ship within the timeframe originally promised, we will contact the customer with an updated shipping date and provide the option to accept the delay or cancel the affected unshipped order for a full refund. This reflects federal requirements for delayed internet orders.
Orders containing both preorder and ready-to-ship products will ship together when all items are ready unless otherwise stated.
Orders
We reserve the right to refuse, limit, or cancel an order for reasons including:
- Product unavailability
- Suspected fraud or unauthorized payment activity
- Incorrect pricing or product information
- An incomplete or invalid shipping address
- Violation of these Terms and Conditions
If we cancel an order after payment has been collected, the affected amount will be refunded to the original payment method.
An order confirmation does not guarantee acceptance of an order. An order is accepted when it is processed for fulfillment.
Payment
Payment is due at checkout and is processed through the payment providers available on our website.
You represent that you are authorized to use the selected payment method and that the billing information provided is accurate.
Shipping
Avenue 89 currently ships within the United States only.
Customers are responsible for providing a complete and accurate delivery address. Avenue 89 is not responsible for delays or failed delivery caused by an incomplete or incorrect address supplied by the customer.
Once an order ships, tracking information will be sent to the email address provided at checkout.
Carrier transit times are separate from Avenue 89’s processing time and are not guaranteed unless expressly stated.

Returns, Exchanges, and Damaged Products
Due to the nature of our products, all sales are final unless an order arrives damaged, defective, or incorrect.
We do not accept returns or exchanges based on fragrance preference or for products that have been burned, used, altered, or improperly stored.
Damaged or incorrect orders must be reported within five calendar days of delivery, together with the order number and clear photographs of the product, shipping box, interior packaging, and shipping label.
Approved claims may be resolved through a replacement, store credit, or refund, depending on product availability and the circumstances of the claim.
Order Changes and Cancellations
Requests to change or cancel an order should be submitted as soon as possible.
We may be unable to change or cancel an order after it has entered processing, production, or fulfillment. Preorder cancellation rights relating to a shipping delay are addressed separately in the Preorders section.
Intellectual Property
All website content—including the Avenue 89 name, logo, product names, scent descriptions, photographs, packaging designs, graphics, text, and other original materials—is owned by or licensed to Avenue 89 and is protected by applicable intellectual-property laws.
Content may not be copied, reproduced, modified, distributed, published, displayed, or used commercially without prior written permission from Avenue 89.
Prohibited Uses
You may not use our website:
- For unlawful, fraudulent, or abusive activity
- To interfere with website security or operation
- To introduce malicious code or harmful technology

Where liability cannot legally be excluded, Avenue 89’s total liability will not exceed the amount paid for the product or order giving rise to the claim.
